In our conversations with public-sector leaders across the world, we hear real urgency—and a fair amount of anxiety—about the need to transform government services. At the national, state, and city levels, governments know they must find new ways to meet the expectations of citizens, many of whom are increasingly discontented. Often governments must also provide “more for less” in an environment of fiscal constraint, and myriad forces that trigger government transformations make their task more challenging.  

What distinguishes the 20 percent of transformations that succeed from the 80 percent that do not? Our study distilled five essential disciplines, “the five Cs,” and found that transformations that apply to all of them are more than three times as likely as other change initiatives to succeed. The disciplines are as follows: committed leadership, clear purpose and priorities, cadence and coordination in delivery, compelling communication, and capability for change.  

These might seem obvious, but they are rarely applied effectively—and they are particularly difficult to implement in the context of the political cycles, complex delivery systems, and multiple stakeholders that characterize the justice sector. 


##### Committed leadership  
The experience of the transformation leaders we interviewed made it clear that a high degree of personal commitment and energy—and often true courage to challenge established conventions—are necessary in bringing the five Cs to life.  
Leaders of successful transformations were twice as likely as their peers in unsuccessful initiatives to model the behaviour they expected of public servants.  


##### Clear purpose and priorities  
Successful transformations paint a compelling picture of their destination—and make it crystal clear to public servants and citizens why the change is necessary. When it comes to objectives, less is more: successful efforts keep targets few, specific, and outcome based.  


##### Cadence and coordination in delivery  
Successful transformation efforts are characterized by smart approaches to delivery, which differ markedly from traditional public-sector approaches to policy development and implementation. A smart approach requires a fast yet steady pace, a flatter hierarchy with close collaboration among different agencies and functions, and the flexibility to solve problems as they arise. It also requires an empowered and focused transformation team to spur the pace and track progress.   


##### Compelling communication  
Every government communicates, but only a few do so effectively enough to win hearts and minds. Engaging more with frontline employees such as: Judges, Court Clerks, Judicial Assistants, Courtroom Reporters, and Interpreters would have enhanced success. Transformations need well-planned, in-depth, genuine two-way communication with all the groups affected by the change—especially the organizations’ own staff. 


##### Capability for change  
Finally, governments, courts and justice agencies need to rethink their approach to public-service capabilities if they are to increase their odds of success in major change programs. Over centuries, governments have honed their skills in areas such as policy and diplomacy. They now need to build new capacity and encourage agility to transform how they deliver services. 


##### Beyond the five Cs: Putting citizens at the heart of transformations  
The task of transforming large-scale public-sector organizations is daunting—all the more so given the high failure rate revealed in our survey. By embedding the five Cs, public-sector leaders can substantially improve their odds of success (Exhibit 3). However, our study also identified further technology-inspired techniques to support faster and better change: citizen experience, design thinking, and agile practices. Pioneering organizations are using the concept of citizen experience to understand people’s end-to-end journeys in services such as public transport and business licensing. They are drawing on design thinking to reconfigure such services in a way that integrates the needs of people, the possibilities of technology, and the requirements of the provider organization. And they are deploying agile practices to quickly design, prototype, and test services with users.

Elements of a Successful Judicial Transformation 

In a perfect world, IT simplification and digital transformation go hand in glove. Simplifying IT helps a digital transformation to succeed: it is far easier, for example, to develop new digital services in a “clean” IT landscape—with a reduced number of applications, interfaces, and technologies— than in a complex one. At the same time, a digital transformation offers opportunities to simplify IT and allows CIOs to take advantage of a significant investment budget along with strong buy-in from the business function and commitment from leadership. 


##### Intelligent Demand Management
This helps business units develop a clear understanding of the IT resources—and cost drivers—that are needed to keep day-to-day IT operations running and to take on new projects, so managers can maximize value with informed decisions, effective resource allocation, and efficient use.

Justice systems worldwide are under increasing pressure, as legal complexity rises, and more people rightfully demand access to justice. Digital transformation is the key for courts to keep pace. Digital justice is an immense chance to improve the lives of millions of people, but only if the technology is understood and implemented fast.  


#### Drivers of Digital Justice
Globally, the digitalization of justice systems is just beginning and generally lagging behind the digital transformation of the rest of society. This has led to a widening gap between the expected user experience, for both consumers and businesses, and the actual services provided by the courts.  


#### Status quo of Digital Justice Transformation  
The current state of digital justice can be understood using an adapted version of the three-layer framework that was previously developed for private legal technology: it differentiates between enabler, process support, and substantial law solutions. Compared to other parts of the legal system, courts and public offices are several years behind in technology adoption. Despite recent incentives to innovate during the COVID-19 pandemic, even economically strong countries risk missing the boat when it comes to future readiness. Insufficient hardware and software infrastructure, budget issues, a hindering mindset, and fear of personal disadvantages among stakeholders are all to blame.  


#### International Best Practices  
Saudi Arabia, Los Angeles, New York, Austria, Canada, Singapore, and the United Kingdom are leading in justice digitalization. They demonstrate several key traits that aid the successful digital transformation of a justice system. The adoption of software development best practices from the private sector, early, strong, and decisive leadership, user-centricity, and openness to process optimization and data-based strategies, have helped them manage the relevant changes. 

 
#### Future of Digital Justice   
Digital justice enables faster, more efficient case management and the effective resolution of legal conflicts, better working conditions within courts, and greater access to the legal system. Countries that strive for these positive results require a bold vision at the outset, purposefully designed governance, and an adapted legal framework to ring in the required paradigm shift. For help, they can tap into a young generation of judges, clerks, and other civil servants who are eager to bet on technology to advance their country and their careers.

Court Tech trends shaping Digital Justice 

Contrary to public perception, technology has always had a significant role within courts. Supportive technology is used as a matter of routine, and includes audio-visual links (‘AVLs’), e-filing, e-discovery, real-time transcription services, and the use of devices on the bench and at the bar table. 

 

AVL technology in particular has been in use for decades, reaching ubiquity across various courts, globally.  Legislation authorises the appearance by AVL for witnesses and parties, including criminal defendants, and is a matter for the primary judge’s discretion exercised in accordance with the circumstances of a particular case. In general, a direction to use AVL requires certain minimum technological requirements to be met. In certain courts three further restrictions exist, most significantly, that AVL is not to be used if it would be unfair to any party to the proceeding. Unfairness is a broad evaluative judgment that considers if there are issues relating to credibility, documents, technology, length of cross examination or availability of alternatives. Traditionally, in a criminal context, the physical appearance of self-represented prisoners during cross-examination is favored, while in civil matters, it has been held that viva voce evidence is preferable to evidence adduced using AVL. Judges are also accorded broad discretion to sentence over AVL, based on similar considerations such as the interests of justice and the reasonable practicability of using AVL. Generally, there are four well-established precedents for using AVLs: (1) for vulnerable witnesses, such as children; (2) for other witnesses, such as those in a foreign jurisdiction, to testify from a location outside the courtroom for cost-saving or convenience; (3) to link prisoners in correctional facilities to courtrooms to conduct remands, pre-trial hearings or bail applications; and (4) to provide ancillary services such as language interpreting or expert reports. 

 

**Vulnerable Witnesses**    

From their first deployment through CCTV to video conferencing today, AVLs have served the essential purpose of allowing vulnerable parties such as children or intimidated witnesses to give evidence in relation to sensitive matters. Early studies found children preferred giving testimony by AVL and were ‘significantly less unhappy, more audible and more forthcoming’, or less likely to cry, report fear, or describe the trial as unfair. Later studies confirmed that remote testimony can increase the confidence of victims in criminal trials when they described intimate experiences and lead to higher quality testimony. AVLs are also preferred over the alternatives of using physical screens, intermediaries, written submissions, or pre-recorded evidence, as it preserves judges’ ability to interpret demeanour, and witnesses can also still participate in the ‘warm-up’ of an examination in chief. Several courts have acknowledged that the remote witness facility provides a measure of comfort and security to victims, being highly utilised by over 2,050 witnesses in 2018. For other disadvantaged groups, AVLs can be useful where the structure and formality of the courtroom may otherwise be alienating. Not having to enter the foreign setting of a courtroom may assist in Indigenous Australians’ effective participation in the justice system; as they are ‘seen as another type of vulnerable witness’. Similarly, legislation empowers the use of AVL for ‘a cognitively impaired person’, as some research shows persons with mental illness can more easily become stressed and aggressive in a court environment and have negative ‘experience(s) of justice’ as a result.  

 

**Remote Participation**   

AVLs have also been recognised as a way to improve accessibility and expedite the administration of justice where distance, cost or poor health is an issue. The technology is used to facilitate remote appearances both domestically and internationally. In various countries, adoption of AVLs has been especially prevalent as it helps mitigate large geographical distances. The technology is used across all courts, up to and including the High Court, where it is often used for hearings of special leave applications and single Justice hearings; to lower courts, where there is the greatest concentration of use. In the face of a wider decline in Local Court circuit services, AVLs help minimise delay for regional participants and free up court resources by omitting the need for court staff to travel. Remote witness technology also allows evidence to be taken from overseas. Prior to the advent of AVL such testimony would need to be obtained through evidence on commission, including through The Hague Convention on the Taking of Evidence Abroad in Civil or Commercial Matters (‘Hague Evidence Convention’).  The advent of AVLs allowed countries to skip the slow and cumbersome process of sending formal letters through diplomatic channels to achieve the Hague Evidence Convention’s requirements. It also eliminates logistical burdens such as visas, prevents forum shopping and is less environmentally harmful. While initially courts disapproved of overseas witness testimony where credit was an issue, this has become less of a concern with the availability of high quality AVL. 

 

**Prisoners**   

All jurisdictions have legislation allowing for an accused prisoner to appear in court by AVL, with certain matters such as adjournments, mentions, continuing remand and subsequent bail applications, even being encouraged. They are also used regularly for consultations between prisoners and defence solicitors. However, for more serious proceedings, most jurisdictions have a presumption in favour of a defendant’s physical appearance. Security was also a relevant imperative for using AVLs, as a way of mitigating risks associated with inmate movement between correction facilities or where court participants may be endangered in certain mafia-type trials. Some scholars have argued that AVLs are more humane for defendants in custody, as it avoids prison transport trips, strip searches and waiting in holding cells. In one study, many prisoners were happy to have their matter ‘over and done with quick as possible’; although others were still required to wait long hours before and after their AVL.   

 

**Ancillary Services**  

AVLs also facilitate access to services including interpreters and expert witnesses that might otherwise not be available on site at the court or tribunal. The role of an expert witness is to assist the court with technical and scientific expertise. Although expert evidence can be admitted into evidence by consent, it is often common, especially in criminal trials, for experts to give evidence either in-person or remotely using AVL. Because expert witnesses often lack availability, AVLs can help overcome delays arising from scheduling. However, some research has underscored that remoteness can reduce the quality of communication and lead to higher error rates with interpreting services or lower quality expert testimony.

Remote hearings in the pre-pandemic world 

Technology is only as good as its weakest link. The metaverse is now evolving rapidly because the technologies that are converging to enable it are improving fast. Moore’s law continues to drive increases in computing power. Comparable “laws” named after George Gilder and Martin Cooper are driving increases in bandwidth and spectrum, respectively, thereby fueling faster and better connectivity and providing higher-fidelity renderings that better mimic real-world latency. 

As a result of these improvements, growth in both the consumer and enterprise metaverse markets has been robust over the last few years. 


#### Set a broad vision 
As the metaverse evolves and matures, many more use cases will join the dozens that already exist. At this early stage, courts should set a broad vision for what they want to achieve, including clear definitions of what to do and what not to do. Experience suggests that it’s critical to push broad alignment through the organization so that teams can act with autonomy as they experiment with potential applications. The willingness to experiment, fail, learn, and move quickly to the next use case, is key. 


#### Build the necessary digital assets and tech enablers 
Start with a technology audit across the metaverse stack to identify gaps that could hinder achievement of goals. Build the technical platforms and tools (such as a data capability) that will facilitate implementation of the strategy and expansion of the effort over time as it generates results. 


#### Create a digital-twin strategy 
It’s important to start embedding metaverse use cases into regular operations at an early stage. Look for opportunities to automate or digitize operations and develop IoT use cases across verticals that support the current and future business roadmap. For example, digital twins using real-time data from current facilities or operations can be used for managing and monitoring, training and development, or design and improvement purposes. 

 
#### Pursue metaverse use case discovery 
To demonstrate the value of the metaverse to the courts’ operations, address specific customer pain points and develop use cases that can drive new sources of revenue. In-depth research into how customer journeys are evolving will lead to important insights that can help define a business’s metaverse roadmap. 

 
#### Build metaverse customer trust 
The metaverse is new, and many customers will be wary and take a wait-and-see approach. Companies need to carefully think through how they will build customer trust. Demonstrating good Web 3.0 data stewardship and showing how the company is leveraging blockchain technology to ensure privacy and security are just the beginning. 

 
#### Provide personalized attention with AI 
The combination of the metaverse and AI enables segment-of-one offerings that can be a powerful differentiator in increasingly competitive sectors. But to build these capabilities, companies must develop the ability to continuously update their understanding of evolving customer needs to deliver ongoing personalized attention and engagement. 

 
#### Monitor and measure progress 
Developing a clear definition of what winning looks like in the fast-changing metaverse can be difficult. Try creating dashboards of transparent, real-time metrics, including Web 3.0 forward-looking frameworks, to monitor and assess product, team, customer, and operations performance. 

 
#### Engage the organization 
Companies can engage employees in the metaverse journey and enhance the employee experience by using the metaverse in hiring, onboarding, coaching, and training. If employees experience the metaverse firsthand, they will be more likely to accelerate change.

Azure maintains one of the most mature and respected business continuity management programs in the industry. The goal of business continuity in Azure is to build and advance recoverability and resiliency for all independently recoverable services, whether a service is customer-facing (part of an Azure offering) or an internal supporting platform service. In understanding business continuity, it's important to note that many offerings are made up of multiple services.   


At Azure, each service is statically identified through tooling and is the unit of measure used for privacy, security, inventory, risk business continuity management, and other functions. To properly measure capabilities of a service, the three elements of people, process, and technology are included for each service, whatever the service type.

For example: 
- If there's a business process based on people, such as a help desk or team, the service delivery is what they do. The people use processes and technology to perform the service.  
- If there's technology as a service, such as Azure Virtual Machines, the service delivery is the technology along with the people and processes that support its operation. 

 
##### **Shared responsibility model**   
Many of the offerings Azure provides require customers to set up disaster recovery in multiple regions and aren't the responsibility of Microsoft. Not all Azure services automatically replicate data or automatically fall back from a failed region to cross-replicate to another enabled region. In these cases, recovery and replication must be configured by the customer. Microsoft does ensure that the baseline infrastructure and platform services are available. But in some scenarios, usage requires the customer to duplicate their deployments and storage in a multi-region capacity, if they opt to. These examples illustrate the shared responsibility model. It's a fundamental pillar in your business continuity and disaster recovery strategy.  


##### **Division of responsibility**  
In any on-premises datacenter, you own the whole stack. As you move assets to the cloud, some responsibilities transfer to Microsoft. The following diagram illustrates areas and division of responsibility between you and Microsoft according to the type of deployment.

A good example of the shared responsibility model is the deployment of virtual machines. If a customer wants to set up cross-region replication for resiliency if there's region failure, they must deploy a duplicate set of virtual machines in an alternate enabled region. Azure doesn't automatically replicate these services over if there's a failure. It's the customer's responsibility to deploy necessary assets. The customer must have a process to manually change primary regions, or they must use a traffic manager to detect and automatically fail over.
